Thanks to Gaijin who IM'd me with the heads up.

Black Label Games, a studio of Vivendi Universal Games (VU Games), has announced it has entered into a production agreement with Liquid Entertainment to develop “The Lord of the Rings™: The War of the Ring,” a real-time strategy (RTS) game for the PC platform. The game will be developed through VU Games’ long-term agreement with Tolkien Enterprises to create interactive entertainment based on J.R.R. Tolkien’s epic novel “The Lord of the Rings.” The game will be released in early 2004.

Expanding on the world of Middle-earth and its inhabitants as introduced by J.R.R. Tolkien, the game allows players to engage in the epic story though both a good and an evil single-player campaign. Players also will be able to play on both sides in an extensive multi-player mode.

“The selection of Liquid Entertainment, recognized in the gaming industry for their PC strategy title, ‘Battle Realms,’ as the developer for ‘The War of the Ring’ underscores our long-term commitment to creating high-quality titles based on the Tolkien works,” said Torrie Dorrell, general manager of Black Label Games.

The Judge asked the Jury to consider if the Elcomsoft had intended the eBook reader to be used for copyright violation, and today the Jury agreed.

"Today's jury verdict sends a strong message to federal prosecutors who believe that tool makers should be thrown in jail just because a copyright owner doesn't like the tools they build," said EFF Senior Intellectual Property Attorney Fred von Lohmann.

We'll get ya'! says the Business Software Alliance in its response to the verdict.

"The DMCA has clear criminal penalties that can and should be imposed in cases of direct or attempted theft of software and other digital content … we would urge prosecutors to continue aggressively pursuing alleged violations of the law," it said in a shameful statement that willfully associates legal fair use with piracy. (Adobe is also a BSA member).

There's a long way to go. The DMCA is being used to prosecute a Norweigian who wanted to play his DVD on Linux, and was recently cited in a case that claimed price lists were trade secrets, and a successful attempt to takedown a parody site.

Well, Battle Realms (by the same company) was pretty innovative, seeing that it was a different type of RTS compared to Red Alert or AoE
