Another classic case of a big oops for an e-tailer today. Ubid.com listed several Western Digital hard drives incorrectly causing a mass amount of orders and angry and puzzled consumers. At one point a 160GB Western Digital ATA hard drive was going for a mere $23.99, bargain! Ubid were also a little puzzled over the RRP on some of their other drives, $ 1,510.99 for a 40GB Western Digital, who are they trying to kid? Most of the listings have been changed back to their correct price but some are still unchanged.

As with many other internet muck ups, customers are very unlikely to get the hard drives at $23.99. With classic cases like Amazon and the iPaq and Fujitsu's big camera discount, customers had no leg to stand on. The same applies here. A few Neowin members are reporting that their accounts look as if they're being charged so it'll be interesting to see how that developes for ubid. Lets hope they don't go changing anymore prices soon ;) Check out our thread in the forums for ongoing discussion (link below).

Yeah, I saw the thread too late to get my hands on one. Be interesting to see if the Neowin members that actually DID buy the hard drives for that price will actually get them.

well if someone did order them and they agreed to a contract, the price they advertised is the price they pay thats whats in the contract. So they should get them for that price.

I was ready to order, have family in the USA I can get them shipped too, but I doubt I would get them for that price.

Heck, I'll sell a couple 160gb hard drives for $26.99 each also, but first I have too sell a few of them for $3,166.99 each , then I'll sell the rest @ $26.99

(Free shipping on Hard drives above $3,000. just cause I'm nice guy)

so should i order that 160 gb drive with price mistake? my dad will kill me if he ends up paying 3,000 for a hd instead of 26.99

edit: oh well.... im not gonna bother getting it
but if ubid honors that then u guys are one lucky ********

Sorry to say, but since this was a typographical error, you guys won't get your drives at that low price.

If uBid has in fact charged customer's accounts the money - they should be under obligation to ship the product. The previous cases cited in the original post were able to avoid shipping the product because no charge was placed on the customer's account. It is the act of charging the customer's account that "completes" the agreement and makes it legally binding. At least this is what Dell, Amazon, et al has always claimed: "it's not an agreement until we actually charge the customer - we can cancel the order before that"

We'll have to see what happens...

sorry to say, but a disclaimer never had any legal value.
in fact it only means to calm down people that could be offended but never can prevent suing.
if not i can make a child porn site and say in a disclaimer that i am not responsible for offending content.
the fact is, they should detect typos before validating the sell, like would do a real employee in a real store.
if the money order has been validated and money is already transfered, there is no legal mean to go back.
now they should ship all HD for wich they took money. that s is simple.
now i should cry as i did not order one(or more...). that is also simple.

Read their "users agreement".....if there is an "opps" like that, it's
not their fault.
