Oops! Microsoft forgets to trademark 'Windows Azure'

Although Microsoft registered the Web site for its new Windows Azure more than 14 years ago, it has not trademarked the name of its new cloud-based operating system, Windows Azure, Internet searches revealed Monday.

According to searches conducted by Computerworld, Microsoft has not applied for a trademark for either "Windows Azure" or "Azure Services Platform" with the U.S. Patent and Trademark Office. Microsoft used both names to describe its software-plus-services technology.

Microsoft's own trademark list also omits Azure, though that list has not been updated since earlier this month.

Well why don't they hurry up & do it? Or why doesn't someone else trademark it & sell it to Microsoft for a bomb? I would!

In order to get a trademark, you have to prove that you deserve to have it and that it does not belong to another company. Also, there is a certain waiting period in which other parties can submit complaints against a pending trademark and I'm sure MS lawyers would file a complaint.

And I would hope that the TM office would realize that it belongs to MS.

Err is this a lack of understanding of how US Trademark laws work in the US?

US Trademarks are created automatically, without registration, when they are "first used in commerce"... So Microsoft does not have to rush in registering the product names at all.

Registration is only needed when you actually take the issue to court... The court upholds the trademark which can prove it was used in commerce first.

Pre-registration does NOT meet the "in commerce" legal requirement!

Seriously... sometimes I wonder why things like this get reported... I think some of these online "journalists" have wayyyy too much time on their hands.

Or maybe Windows Azure is a bust and they've decided not to pursue it after all.
