International rap star Eminem has been given the US court"s go-ahead to continue his suit against Apple, its advertising agency TBWA/Chiat/Day and MTV. Though some claims in the case were disallowed the artist can press on with the suit, which alleges the defendants broke federal copyright law and falsely implied the artist had endorsed Apple"s iTunes Music Store and iPod.
An MTV Apple TV advertisement in the US had featured a ten-year old singing Eminem"s track, Lose Yourself. Two claims of unfair competition and unjust enrichment were rejected, reports the Detroit News. The ad was screened for three months beginning July 2003, and was also made available on Apple"s Web site.
