A man who live streamed the birth of his son has lost one of a series of cases for copyright infringement which he filed against numerous TV broadcasters and news sites for airing and posting the footage.
Kali Kanongataa filmed the birth of his son on Facebook Live in May 2016. He originally intended to only share the footage with family and friends, but realized about half an hour into filming that the stream was public.
Approximately 120,000 people watched the stream but after news organizations such as ABC played sections of the video on TV and posted it online, Kanongataa filed a series of lawsuits against them, claiming they had infringed upon copyright laws. In September 2016, Kanongataa sued ABC News and Yahoo because parts of the video had been played on Good Morning America, and on a Yahoo site which hosts ABC content. Kanongataa has also filed infringement claims against COED Media Group, iHeart Media, Cox Communications and Rodale, the company that produces Women"s Health Magazine. A PDF of the suit filed against ABC and Yahoo can be viewed here.
Kanongataa"s case against ABC, NBC, Yahoo and COED Media Group, was dismissed earlier this week, after consideration of a motion passed by ABC lawyers last November which stated that the use of the footage was a "textbook example of fair use". The cases against Rodale and Cox Communications are still pending.
