Samsung seems to be getting into yet another long legal battle as a US court has decided to continue with the lawsuit filed by Microsoft against the company.
Microsoft recently sued Samsung for defaulting on Android royalties for the year 2013, which were paid at a later date without interest. In response, Samsung requested that the lawsuit be put on hold as the company is in process of arbitration in Hong Kong.
At the beginning of November, Samsung filed an antitrust complaint against Microsoft for alleged breach of a 2011 contract due to the Nokia hardware division acquisition by Microsoft. According to Samsung, the acquisition made Microsoft a direct competitor of the company and was therefore making their partnership a case of collusion.
Samsung still owes Microsoft $6.9 million and the US District Court of Southern New York has confirmed that the lawsuit will proceed, even though Samsung is seeking arbitration with the International Chamber of Commerce in Hong Kong.
Both companies have yet to comment on the court"s decision, but regardless , this won"t be the last we hear about this legal battle.
Update: A Microsoft spokesperson has provided the following statement regarding the lawsuit venue, which Samsung probably wanted to change due to its arbitration process.
Microsoft is pleased that the Court agrees that New York is the appropriate venue for this dispute.
