Darconf
I had actually planned to have a windows 7 launch party. but i was passed over so you could deceptively make a few bucks, then brag about it. thanks. pretty chicken**** of you. Guess that makes you a thief AND a liar Edited October 16, 2009 by Darconf Link to comment https://www.neowin.net/forum/topic/834206-i-fought-microsoft-over-selling-nfr-software-and-i-won/page/3/#findComment-591710892 Share on other sites
FloatingFatMan
You know what? I didn't apply for the launch party thing as I didn't have the time to hold a party and am an honest sort. I've got a copy of W7 on pre-order; when it arrives, I'm going to hold a launch party ANYWAY, and email the pics etc to Microsoft, with a link to this thread. :p Link to comment https://www.neowin.net/forum/topic/834206-i-fought-microsoft-over-selling-nfr-software-and-i-won/page/3/#findComment-591710914 Share on other sites

The_Decryptor Veteran Posted October 16, 2009 Veteran Share Posted October 16, 2009 fail.I hope MS pursue this and takes legal action against you. I doubt they would, they would lose if they tried it. It's his copy of Windows, he decides what he does with it. sweetsam
Like I said in another thread gone are the days where morals and ethics were respected and upheld without a law in place that demanded it. Who would have made it legal to sell a 'NOT FOR SALE' item ? That is some quality justice right there. Apparently common sense took a break and idiots went to work. Way to ruin the fun for other people. Somebody who was genuinely interested in holding windows 7 party lost out because you wanted to make a few bucks. What goes around comes around. What you sow is what you reap. And for those wise souls that wanna give kudos for sticking it to Microsoft you think you won by doing something unethical ? Really ? In this case Microsoft was right no matter how much you hate them. And you know what is sad ? He is on front page of Neowin. Elessar
I doubt they would, they would lose if they tried it.It's his copy of Windows, he decides what he does with it. It's MS. I'm sure they have some criteria for the launch event hidden throughout the fine print. As much as I would love for MS to sue him, they have bigger fish to fry :/ Link to comment https://www.neowin.net/forum/topic/834206-i-fought-microsoft-over-selling-nfr-software-and-i-won/page/3/#findComment-591710984 Share on other sites
FloatingFatMan
I doubt they would, they would lose if they tried it.It's his copy of Windows, he decides what he does with it. IF he doesn't hold the launch party, then technically, he obtained the software through false representation. I doubt MS would actually bother to sue him, but they very likely COULD. One thing is sure though, you can bet his email and physical address etc have been blacklisted from any future offers. ozgeek
You are 38? Grow the hell more up! Show some respect for others. You sound like a 5 year old idiot. Taking things for free then selling them without respect for those who really need it more than you do and would have gotten it for free. I'm "ordering" you to give the package to someone else (AT NO CHARGE) if you can't uphold your end of the conditions. "Not for Resale" DOES have legal binding. Any companies that give away "Not For Resale" items and see you selling them CAN sue you. Usually those items comes with terms and conditions which ARE legal binding. They designed to protect the company, not you. If terms and conditions was not legal binding then so many companies wouldn't bother with writing them up. Reverse Engineer
Taking into account how the law is always slanted in a companies favour, how they try and trick you to let them spread your email and personal information around (please tick the box that is unticked if you wish to opt out of our information sharing scheme wherein unticking said box determines you agree that we are allowed to share your information if said box is either ticked or unticked...) i fully support this outcome. What i can't believe is the volume of people who WANT companies to have the upper hand over them. I never knew so many people would actually volunteer to be a slave. Shocking. Damian
Good job roadwarrior. I would have done the same thing over and over (Y) @Op, you know... If you DON'T hold a launch party, or fail to upload the pics etc to the provided site, MS could easily sue you for breach of contract and obtaining goods under false pretences? It would serve you right too. That was a pretty ****ty thing to do really; you clearly had no need of the signed copy and only ever wanted it to sell for profit. LOL. sue for not holding a party... Good luck to any sucker who buys it thou :) It's not like i'll kill the electrical companies business by blowing up transformer stations, i know it's kind of an extreme point, but the point is not that Microsoft can't cope with it, it's the fact that there were users that could've used those kits who didn't get it, because people took and sold them instead of using them for their intended purpose. He's no better than a ticket scalper, though atleast they pay for the tickets. FloatingFatMan
LOL. sue for not holding a party... That it's a party is irrelevant. What IS relevant, is that it's listed under the terms and conditions of getting the pack that you hold a launch party and promote their product. If you don't, you're in breach of contract. I doubt MS will bother, but legally, they would be well within their rights. Jme621
LOL. sue for not holding a party... sure why not, he did agree to host a party in return for being considered for the contest. So in theory it is a breach of contract with houseparty.com, they would be the ones to sue him, not ms. and for reference, i love it when they post their links, i report them all to houseparty.com and ebay along with copy of the terms of use they agreed to when entering. so far i am 14/14 on getting auctions closed hehe. maybe one was this guys who knows. and no im not bitter, i got a pack also, but mine will be used for what it was intended. Lechio
Good work. FISKER_Q
Yes, because selling a party pack is a heinous crime, and one deserving of a 911 call?: . So we should only be allowed to report serious crimes? So i shouldn't call in common burglary, but call in murder? Communities have standards, people try to uphold these standards, absolutely nothing wrong in that. Pharos
I doubt they would, they would lose if they tried it.It's his copy of Windows, he decides what he does with it. Oh sure, I have my copy of Windows, let me share the product key with all my friends. I decide what I do with it. NOT. First of all it's not even his, he holds the License and Microsoft can revoke it pretty much whenever it feels like it. There's a big fat "NOT FOR RESALE" tag written on the CD. I sincerely hope Microsoft has the records of every serial key tied with each address they sent the package to, so they can blacklist the keys these crooks are trying to sell. What a douche. Seriously. Link to comment https://www.neowin.net/forum/topic/834206-i-fought-microsoft-over-selling-nfr-software-and-i-won/page/3/#findComment-591711240 Share on other sites
